+Terms and Conditions Cotec Protective Coatings Ltd 33 Dippol Boswell Park, Auchinleck, Ayrshire, Scotland Ka18 2BZ By placing an order either by email over the phone or via the website, the customer accepts verbal or written agreement and is bound by the terms and conditions below: Payments for services 1.1 Unless otherwise agreed, payments by cheque, card, cash, online transfer or invoice by arrangement. Cheques should be made payable to Cotec Protective Coatings Ltd, the customer will be responsible for all bank and legal charges resulting from returned cheques(s). Bank details for online transfer are sort code 80-22-60 and account number 10848164. If paying by bank transfer the customer must include invoice number as the ‘reference’ to allow correct reconciliation of the customer’s account. 1.2 Duration of cleaning/coating and the associated charges may only be queried or adjusted within one week of the service delivery date. 1.3 If payment is not made 7 days from the date of the invoice the account may be suspended and may be passed to a third party collection agency. Additional charges for the recovery of the overdue debts may applied to your amount. 1.4 We reserve the right to claim statutory interest at 8% above the Bank of England base rate in force at the date the debt becomes overdue and at any subsequent rate where the base rate changes and debt remains unpaid in accordance with Late Payment of Commercial Debts (Interest) Act 1998 as amended and supplemented by the Late Payment of Commercial Debts Regulations Services 2.1 The customer agrees to carefully read and acknowledge the terms and conditions upon receipt. 2.2 Although Cotec Protective Coatings Ltd will provide an informed quote/online estimate for the duration of the cleaning/coatings service upon visiting the premises, cleaning time may be adjusted in either direction should any conditions pertaining to the labour required to meet the agreed specifications/standards come into effect since original assessment was undertaken. 2.3 All relevant information pertaining to the access of the client’s property for works to be completed must be confirmed by the client. 2.4 Cotec Protective Coatings Ltd will not be held responsible for any injury or loss suffered to any type of animal or pet as a result of an accident during delivery of service or afterword’s. It is the client’s sole responsibility to keep safe. 2.5 The customer accepts and understands that any issues with the service delivered and/or breakage/damage must be reported within 24 hours from the service date to ensure the Cotec Protective Coatings Ltd are able to rectify any issues promptly. Failure to report such issues within the agreed time frame will negate the customer’s entitlement to refund/compensation or reinstate back to pre-works condition. 2.6 Cotec Protective Coatings Ltd will not be held responsible for any replacement or repair required as a result of the failure of any worn, faulty, incorrectly fitted or fatigued components or other similar items. 2.7 Where it has been agreed the Cotec Protective Coatings Ltd employees are responsible for damage caused to the customer’s property or belongings during the course of the services, Cotec Protective Coatings Ltd will choose to repair the item, replace the item, restore to pre work condition or make an insurance claim to that affect. Cotec Protective Coatings Ltd are responsible for the replacement or repair and it is not the customer’s responsibility to replace or repair an item without the agreement of Cotec Protective Coatings Ltd. 2.8 Cotec Protective Coatings Ltd have Public and employer’s liability insure policy in place. The policy will cover any accidental damage caused by an operator working on behalf of Cotec Protective Coatings Ltd, reported within 24 hours of service date. 2.9 Cotec Protective Coatings Ltd agrees to keep all customer’s information confidential. 2.10 Start times for cleaning/coating sessions are a guide only, to within around 30 minutes. Cotec Protective Coatings Ltd will endeavour to inform clients of late or early visits but this is not guaranteed. 2.11 Whilst the chosen day(s) and times for start of works may be subject to change as due to changes in external factors or under unusual circumstances. but with communication to the customer to that effect. 2.12 The client agrees when Cotec Protective Coatings Ltd starts this is now deemed a site and therefore no unauthorised personal will be allowed access. Customer satisfaction 4.1 The customer will allow Cotec protective Coatings Ltd to revisit any job(s) with which they are not satisfied. 4.2 For regular or one off services invoices cannot be adjusted retrospectively where complaints have not been promptly reported as per the condition in 2.5. 4.3 Cotec Protective Coatings Ltd may contact you after services is completed to obtain a feedback report. 4.4 Cotec Protective Coatings Ltd reserves the right to use any photograph/video taken of any work, without the expressed written permission of those property which is included within the photograph/video unless otherwise stated or in writing, your desire to not have your photograph/video used. Cancellations 5.1 The customer may cancel by giving more than 5 working days’ notice, but a minimum of one week is preferred to avoid any charges. 5.2 The customer will be charge for any scheduled works which cannot take place upon arrival of the team. This is applicable to any circumstance which is deemed not to be the fault of the company. A none exhaustive list of examples: no access provided, obstructions that prevent works to be carried safely, no water supply available, team turned away by the customer or neighbour intervention. 5.3 Any loss of profit caused by your cancellation and is not in terms with 5.1. may be charge to the customer (e.g. where they set aside time to do your work and can’t book another job for the same period.) 5.4 Service costs may be charged up until the time you cancelled. Health and safety 6.1 Cotec Protective Coatings Ltd will not be responsible or liable for accidents, injury, loss or harm which may come to the client, client’s kindred, client’s employees and unauthorised personal on site of the client or their subcontractors. 6.2 Cotec Protective Coatings Ltd is responsible for the health and safety of their employees before during and after cleaning/coatings sessions. 6.3 Where the client provides or requests the use of their own equipment, materials and/or chemicals, the client is responsible for all matters pertaining to health and safety in respect of using the aforementioned equipment, materials and/or chemicals, as well as any damage or liability relating to property treated with said equipment, materials and/or chemicals. Cancellation and refunds This and the following paragraph apply if you buy as a consumer as defined in the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Provided the Regulations apply to the transaction concerned, then the following terms apply to this contract. 1.1 We now inform you that information relating to all aspects of our Products and Services is not in this document but in other web pages from where you select the Product or Service. 1.2 You have a right to cancel the contract within 14 days of placing your order on selected items 1.3 Every Product or Service provided by us is designated to be delivered as soon as we are reasonably able to deliver it. Shipment of most products begin automatically after you have made payment. 1.4 We do not supply any product or service on terms for future delivery. That means, if you wish to use our Products or Services, you must instruct us to deliver in accordance with our terms. 1.5 By accepting these terms, you now agree that you are instructing us to deliver immediately and you understand that, in doing so, you lose your right to cancel your order within 14 days. 1.6 So far as concerns Services you buy from us, if any service is continuing, you may cancel selected items at any time before we have completely provided it. That means no new cancellation right arises if you add to your original instructions. 1.8 This paragraph does not affect your rights in the event that there is any material error in the Product. 2 Liability for subsequent defects 2.1 Please check the Product received from us immediately you receive it. 2.2 If you find an error in the Product, you must tell us by email message to cotecprotectivecoatingsltd@gmail.com 2.3 The procedure to report an issue is as follows: 2.3.1 you must report to us as soon as any issues discovered but not later than six months from receipt by you. 2.3.2 please tell us clearly what is the issue you complaining of and other information to enable us to identify the problem. 2.4 If we agree that the Product is faulty, then we shall: 2.4. advise on the issue and come back to you within 3 days, or 2.4.2 refund the full cost you have paid.
